I hereby agree to the following transport terms provided by ShipYourCarNow, LLC (“SYCN”). I understand that SYCN is a broker that procures an independent and unaffiliated transporter (“Transporter”) from within its preferred network to pick up and deliver the Vehicle to the requested destination. I also understand that SYCN only receives a portion of the Total Tariff, or transport total, and that the Transporter receives the remainder (“Balance”).
I further understand that any remaining Balance is due on delivery of the Vehicle by the Transporter, and that it must be paid in full by means of money order, cashiers check or cash at this time to the Transporter unless a full-pay authorization is signed and the full transport total is paid to SYCN. I further understand that the transport will be governed by a bill of lading with the Transporter.
While every effort will be made to arrange for the transport at the estimated First Available Pickup Date identified above, and for the delivery to occur on the estimated delivery date, unfortunately, SYCN cannot guarantee these dates as delays may occur due to mechanical failures, acts of God and other unforeseen circumstances.
Upon the execution of this contract, you agree that SYCN can charge your credit card for its reservation fee. While you may cancel the transport before it commences by calling SYCN at 1-888-532-8805 with a valid order number, and by requesting a cancellation e-mail from the company, the fee SYCN already charged is non-refundable due to its provision of services already performed which includes administrating and arranging for the transport of the Vehicle.
I agree that SYCN will not be responsible for any liability caused directly or indirectly by the Transporter. SYCN does agree to assist you, in the event of an incident occurring during the transport, by providing any and all insurance information for the Transporter that is available to SYCN. Customer hereby waives any and all claims for damages against SYCN that relate in any way to the Vehicle’s transport, and agrees to defend, indemnify, and hold harmless
SYCN from and against any and all claims, losses, costs, damages including attorneys’ fees and expenses of every kind of nature arising from the transport. I further understand that I am responsible for any personal belongings in the
Vehicle. Should I choose to include items in my vehicle, I understand that SYCN is in no way responsible for any fines or fees associated therewith, and that the Transporter’s insurance on the Vehicle during the transport solely covers the Vehicle, and not personal property in the Vehicle.This Terms and Conditions is the parties’ entire agreement on this matter, superseding all previous negotiations or agreements that may contravene any of its terms. In the event either party files a lawsuit which in any way relates to this agreement, the prevailing party shall be entitled to an award of its attorneys’ fees and costs. This agreement is governed by the laws of the State of Florida.
International Transport Terms
Ship Your Car Now operates as an ocean transport intermediary license number 025646. While every effort will be made to confirm a driver/vessel at the estimated amount above and meet the customers requested scheduling, no guarantee of pickup or delivery date can be made. Delays may occur due to carrier/vessel/FF/NVOCC/agent/port schedules, mechanical failure, inclement weather, and unforeseen circumstances. Customer agrees to not use any other broker but ShipYourCarNow, LLC to locate a carrier/vessel for vehicle shipment. While ShipYourCarNow, LLC makes every proactive effort to locate drivers within our network we also post on a national dispatch board that is used by carriers/vessels outside our network. Multiple listings for the same vehicle will only hinder our ability to dispatch your vehicle and may result in a cancellation fee.
All transportation dates of pickup and delivery are estimated and not guaranteed. ShipYourCarNow, LLC will not be responsible for any charges incurred due to delay of pick up or delivery. This includes but is not limited to airline tickets or rental car fees. All order cancellations prior to dispatch must be canceled by calling the offices of ShipYourCarNow, LLC at 1-888-532-8805 with a valid order number and requesting the cancellation procedures email.
We may require the original title to ship your vehicle. If a bank or a credit union owns your vehicle, you must present your order to the bank and obtain written authorization to move your vehicle overseas, as well as signed, stamped and notarized lien letter, and notarized copies of the title front and back. Normally, Customs are going to clear this only if you are military or government affiliated. If your vehicle is new and the title is not available yet, then the original certificate of origin <MSO> and a copy of the bill of sale are required. All originals need to be sent to location of the vehicle for further instructions. If vehicle is recently paid off, we may need signed, stamped, and notarized lien release letter from previous lien holder. Ship Your Car Now is not responsible for verifying vehicle is permitted to be imported into country of destination. Please contact your consulate and verify. All containerized shipments permit the packing of personal goods into the vehicle. If your vehicle is to be shipped on a Roll on Roll off vessel you are not permitted to put any goods in the vehicle.
We suggest that you remove your license plate and/or tags prior to shipping your vehicle and that you take them with you in your baggage. Customs fees, Duties, deconsolidation fees, destination port fees, destination country fees etc are not part of the quoted price and may be due upon the arrival of your vehicle at the destination port. Please consult the consulate of the destination country for additional info. Upon request, we shall provide a detailed breakout of the components of all charges assessed and a true copy of each pertinent document relating to the charges.
Arrival times of the vessel are estimated and are not guaranteed. A bill of lading will be forwarded to the receiver’s address together with the details of our agent who will assist you in receiving your vehicle. The contracted carrier/vessel/FF/NVOCC/agent/port offers marine insurance at the normal rate of between 1.5% and 3% of the value of the vehicle depending on availability, the carrier/vessel/FF/NVOCC/agent/port, and method of shipment. Marine Insurance applies once vehicle is on vessel. Customer is responsible for maintaining insurance on the vehicle prior to vessel sailing. Vehicle is not Insured while waiting to be loaded at the shipping lines terminals.
Your current Insurance must be in force to cover you against any loss or damage until such time as your vehicle is loaded onto the vessel. Carrier insurance only applies during transport from inland pickup to port. If Marine insurance is not purchased, then minor insurance claims will be limited to $500, depending on contracted carrier/vessel/FF/NVOCC/agent/port.
In addition to agreement to the terms and conditions, I understand that at the time of service ShipYourCarNow, LLC will contract a carrier/vessel/FF/NVOCC/agent/port. ShipYourCarNow, LLC will not be responsible for any negligence on the part of the contracted carrier/vessel/FF/NVOCC/agent/port. Customer is also required to maintain automotive insurance on the vehicle up until the vessel which the vehicle is loaded on departs. Any claims must be made with the carrier/vessel/port who actually performed the brokered service. The shipper hereby waives any claim for damages and agrees to defend, indemnify, and hold harmless Ship Your Car Now from and against any and all claims, losses, costs, damages including attorneys’ fees and expenses of every kind of nature arising.
